US EPA designates PFOS and PFAS as hazardous under
Superfund
On September 6, 2022, the U.S. Environmental Protection Agency (EPA) issued a notice of proposed rulemaking to designate perfluorooctanoic acid (PFOA) and 
perfluorooctanesulfonic acid (PFOS) as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA
or Superfund). EPA’s proposed rulemaking on PFOA and PFOS is the first time the Agency has utilized its authority to designate new chemicals as “hazardous substances”
